Matrox Graphics inc., Matrox Central Services and its affiliates (“Matrox”, “we” or “us”), respect the privacy of visitors (“you”, “your”) to our Web site (“Site”). We have developed the present privacy policy (“Policy”) to describe our collection, use, storage, and communication (“processing”) of information about you that directly or indirectly identifies you (“personal information”). This Policy also describes your rights with respect to this information and how to exercise them. By visiting the Site, you agree to be bound by the terms and conditions of this Policy. Our Site uses essential technical cookies to ensure that certain functionalities of the Site work properly, for example forms to request product demos, software downloads, product registrations, online purchases as well as access to secure areas.

  • Analytics cookies: Adobe Marketo Munchkin cookies 
Cookie name Purpose

This cookie is used to track visitor behavior on the specific pages visitors have browsed or engaged with, and also link a visitor to the recipient of an email marketing campaign to measure campaign effectiveness in Marketo. It also sends web page visits and link clicks as event activities to Marketo. 

Tracking is performed anonymously until the visitor identifies themselves by submitting a form. The data provided is stored and processed in Marketo directly, allowing Matrox to use this information for target group creation, interest segmentation, lead generation, experience optimization, and to deliver contextual marketing campaigns. The default lifespan of the Munchkin cookie is 2 years. 

 
Visitors may opt out of Munchkin tracking entirely by adding the querystring parameter “marketo_opt_out=true” to the URL in their browser. 
 

The Marketo Munchkin cookie allows Matrox to track repeated visits to the Site and link each visit to the information voluntarily provided by the visitor. For example, if the visitor is asked to provide his name, company name and email address, the identity of the visitor will be known when he visits the Site at a later date. We also use Marketo Munchkin code to track email open rates and click-through rates, allowing us to manage the email marketing experience, as well as to personalize web content.

  • Security cookies: Google’s reCAPTCHA 
Our Site uses the reCAPTCHA service provided by Google Inc. (Google) to protect your form submissions and check that you are not a bot. To make this determination, ReCAPTCHA collects PII, such as IP address, in accordance with Google's Privacy Policy.
 
  • Tracking and Insight Tag: LinkedIn Conversion 

The LinkedIn Insight Tag is a piece of lightweight JavaScript code that we have added to our Site to enable in-depth campaign reporting and to help us unlock valuable insights about our Site visitors. We use the LinkedIn Insight Tag to track conversions, retarget Site visitors, and unlock additional insights about members interacting with our LinkedIn adverts.

The LinkedIn Insight Tag enables the collection of metadata such as IP address information, timestamp, and events such as page views. All data is encrypted. The LinkedIn browser cookie is stored in a visitor's browser until they delete the cookie, or the cookie expires (there’s a rolling sixmonth expiration from the last time the visitor’s browser loaded the Insight Tag).

2. With whom does Matrox share Personal Information?

2.1. Our Business Partners, Strategic Alliance Companies
If you submit Personal Information to purchase a product or service from a partner or a company with which we have a relationship, we will need to share that Personal Information with the relevant partner/company so that Matrox or the partner/company can process your order(s) to ship, supply, maintain, renew or service the products or services that you requested and you may be contacted by the partner/company for any of these purposes. We shall require that any such partner or company comply with the provisions of this Policy in dealing with any Personal Information we share with them.
 
2.2. Marketing Relationships
If you opt-in, we may share your Personal Information with third parties such as our affiliates, resellers, distributors, agents, and service providers (such as Google and LinkedIn), for marketing purposes. If you do not want your Personal Information shared with such third parties for marketing purposes, you may opt-out of such sharing as described in the Section entitled “Your Rights” below.
 
2.3. Special Cases
Matrox may also use and/or disclose Personal Information in other special cases when we have reason to believe that using and/or disclosing this Personal Information is necessary to identify, contact, or if Matrox deems necessary, bring legal action (including action outside your country of residence) against someone who may be violating Matrox's Terms of Service, end-user license agreements and/or intellectual property rights. The same policy applies in cases where we believe an individual may be causing injury to or interfering with (either intentionally or unintentionally) Matrox's rights or property, other users of an Matrox Site or service, or anyone else that could be harmed by such activities. Matrox may disclose or access Personal Information when we believe in good faith that the law (including laws outside your country of residence) requires it, to comply with legal process, to respond to requests from public authorities including public authorities outside your country of residence, to protect our operations and to permit us to pursue available remedies or limit the damages that we may sustain. This includes exchanging Personal Information with other companies and organizations for fraud protection and credit risk reduction.
 
2.4. Service Providers

We occasionally employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, sending postal mail and e-mail, removing repetitive Personal Information from customer lists, ensuring accuracy of Personal Information, analyzing data, providing marketing assistance, fulfilling purchases and processing credit card payments. We may share Personal Information about you with third parties for the purpose of enabling these third parties to perform such functions.

Our website uses Cloudflare to enhance performance and provide security services, including protection against malicious attacks. As part of its services, Cloudflare may collect and temporarily store certain data, such as IP addresses, timestamps, and pages viewed. This data is used to identify and mitigate security threats and to optimize website performance.

2.6. Assignment

As we continue to develop and expand our products and services, we may sell or buy businesses or product or service lines. In such transactions, customer Personal Information is generally one of the assets transferred. As such, we reserve the right to transfer any and all information that we collect from Site users to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Matrox’s business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings). In addition, in connection with any such transaction, we reserve the right to share Personal Information about you with our consultants and advisors (such as accountants and lawyers).

Please note that some of the recipients listed above may perform activities outside of Canada. Any Personal Information that is processed in countries outside of Canada may be subject to the laws of those countries (e.g., where a third-party service provider operates internationally). As a result, Personal Information may be disclosed in response to valid demands or requests from government authorities, courts, or law enforcement officials in countries outside of Canada. You may seek additional information regarding the Processing of your Personal Information outside of Canada by contacting the DLA at the coordinates listed above.

 

3. Limiting Processing

Matrox limits the Personal Information it processes to what is necessary for the purposes enumerated above. Your Personal Information may be shared internally but only with employees who require access to it to perform their duties.

Matrox will not retain your Personal Information longer than is necessary for the purposes enumerated above. As this purpose varies depending upon the Personal Information involved, we invite you to contact our DLA for any inquiries pertaining specifically to you.

 

4. Accuracy

Matrox uses reasonable efforts to ensure that your Personal Information is kept as accurate, complete, and up to date as possible. We will not routinely update your Personal Information, unless such a process is necessary. To help us maintain and ensure that your Personal Information is accurate and up to date, you must inform us, without delay, of any change in the information you provide us.

 

5. Safeguards

Matrox is committed to protecting the confidentiality, integrity, and availability of your Personal Information. We employ security safeguards that are customary in the technology industry and appropriate to the sensitivity of the information, including physical, organizational, and technological measures. Examples of such measures include restricted access to offices, training of personnel, limiting access to information on a "need-to-know" basis, using passwords and well-defined internal policies and practices. 

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of data transmitted to our internet Site. Any transmission you initiate is at your own risk. Once we have received your information, we will apply our security practices to prevent unauthorized access, use and /or disclosure. 

Matrox stores and processes your Personal Information at our offices in Dorval. We use contractual and other means to provide a comparable level of protection for Personal Information stored, handled, and processed by third party service providers. 

 

6. Your Rights

Depending upon the province in which you live, you have various rights with respect to our processing of your Personal Information. These may include: 

a) Access: You have the right to request whether we hold Personal Information on you and to request a copy of such information. There are exceptions to this right, so that access may be denied if, for example, making the information available to you would reveal Personal Information about another person, or if we are legally prevented from disclosing such information.

b) Accuracy: We aim to keep your Personal Information accurate, current, and complete. We encourage you to contact our DLA to let us know if any Personal Information is not accurate or changes, so that we can update your Personal Information. 

c) Consent Withdrawal: If you have provided your consent to the processing of your Personal Information, you have the right to withdraw your consent fully or partly. Once we have received notification that you have withdrawn your consent, we will no longer process your Personal Information for the purpose(s) to which you originally consented unless there is another legal ground for the processing. 

d) Complaints: Although we would rather you speak to us first, if you believe that your Personal Information protection rights may have been violated, you always have the right to lodge a complaint with the applicable supervisory authority, or to seek a remedy through the courts. 

e) Rights for Quebec Residents: If you reside in the province of Quebec, in certain circumstances, you may also have: i) the right to request that we cease disseminating your Personal Information, ii) the right to request that we de-index any hyperlink attached to your name that provides access to information by a technological means; iii) the right to request that we re-index a link providing access to information; or iv) the right to request that we communicate to you, as well as to any person or body authorized by law to collect such information, any computerized Personal Information collected from you in a commonly used technological format. 

You may enquire about your Personal Information or exercise any of the above rights by contacting our DLA. Matrox will generally respond to all access requests within 30 days of the receipt of all necessary information. In circumstances where we are not able to provide access, or if additional time is required to fulfill a request, we will advise you in writing. 

Matrox may not release certain types of information based upon exemptions specified in applicable laws. Where possible, we will sever the information that will not be disclosed and provide you with access to the remaining information. Should we be unable to provide access to or disclose Personal Information to you, we will provide you with an explanation, subject to restrictions. 

In certain circumstances, such as where the request is excessive or unfounded, we may charge you an administration fee for access to your Personal Information. We may also charge for additional copies. We will advise you of any fees before proceeding with a request. 

 

7. Resolving Concerns

Any report, concern, complaint, or incident of which we become aware that involves conduct that may contravene the Policy will be treated confidentially to the extent possible. However, some disclosure may be necessary to adequately address issues raised, aid enquiry and implement solutions, as appropriate. 

7.1. Issue Reporting and Escalation Process

a) Matrox takes all potential or actual Personal Information issues seriously.

b) You may report your concerns about the processing of your Personal Information directly to the DLA.

c) The DLA will engage the appropriate levels of management to assist with resolution of the issue. 

7.2. Prohibition Against Retaliation

Matrox will not retaliate against an individual who, in good faith, and on the basis of reasonable belief, raises questions or concerns regarding their Personal Information. 

 

8. Maintenance and Review

The Policy is effective December 15th, 2024 and supersedes all prior versions. 

Matrox reserves the right to interpret the Policy at its sole discretion and to make changes as it deems appropriate from time to time without the requirement of advanced notice. 

Personal Information protection legislation continues to evolve and, as a result, this Policy may be amended by us from time to time at our full discretion without any prior notice or liability to you or any other persons. The Processing of your Personal Information by us will be governed by the version of this Policy in effect at that time.
